for Using TES Release Package |

This package
is for the use of people wanting to submit Artwork or Photos for publication
in Prometheus Magazine. There are several forms in this package and all
photos and artwork must be submitted in duplicate. Copies of additional
material proving identity and proof of age are also required with some
of the releases.
The Photo/Art
Release
If a model is used in the photograph (not the piece of artwork) then a
model release
If there any S/m or sexual material portrayed in the photograph (artwork
is exempt) then one of the other three releases must be submitted. This
is because of Title 18 of the US code which needs proof of age and identity
of each model in the photograph.
If the photograph was made before 1995, when the law took effect, then
the photo is exempt from the law. If
this is the case there is a letter in this package
stating same which must be signed by the photographer. If the photo was
posed and no S/m or sexual activity took place immediately before, during
or after the photo was taken, then the photo is exempt from the law and
there is a letter
stating that which must be signed by the photographer. If, however,
the photograph is of sexual activity or (as stated by the law) "S/m
abuse" which we have decided to interpret as any sceneing went on
as the photograph was being made (whether it shows on the photograph or
not) then you have to submit a Model
Release/Primary Producer's Compliance Statement (Form#2).
A whip hitting a body, bondage and certain other images can be interpreted
as prima facie evidence of S/m activity so I will have to make the final
determination whether the Compliance Statement is needed.
The Compliance Statement consists of two parts. The first part is the
Model's Section,
in which the model states that he/she is over the age of 18 and has authorized
TES to use the image. It also requires, for Identification Purposes all
aliases that the model has ever used, scene name, professional names etc.
A copy of the model's photo ID must accompany the release, along with
a copy of the photo. (The photo with the Photo/Art Release will do as
this will all be stored in the same place.) The second section is the
photographers section<.
This section simply states that the photographer has seen and examined
the model's photo ID and found it valid and when the photograph was made.
This all has to be signed and a copy of the photo ID, the picture has
to be kept by the photographer as well. There is an intricate filing system
related to the Names and Aliases of the Model's which I will explain to
any one who asks.
